Research an individual or group that has sustained a grave human right violation. Identify what rights were violated and their sources in domestic and international law. Compare the international standard set vs. the domestic standard. How are they similar? How are they different? – Are domestic remedies available? (Can justice be sought meaningfully through a state court?) If so, analyze the potential results, whether it would address the issues, and provide appropriate recourse. If domestic remedies are not available, discuss why (Ex: due to lack of infrastructure, political interests conflicting with meaningful justice, etc.). This should also briefly explore the court system that is relevant to seek justice within the state. (EX: state court > court of appeals > supreme court) – Are international remedies available? Discuss whether there are treaties or other international instruments that provide protection and/or reporting mechanisms? Identify international instruments that can be used as a tool for justice. Identify the sources of the rights violated and whether NGOs, Special Rapporteurs, or other international entities have an interest in protecting those rights. How can those organizations provide support for the justice sought? This section should also incorporate principles discussed throughout the semester and how international entities can provide political/economic support. – Provide a conclusion and recommendation of next steps that can be taken to promote the enforcement of the right violated. Propose an alternative solution or approach, but this is – Organized as a Memorandum – Introduction, Statement of Facts, Relevant law/protections domestic and international, Analysis, and Conclusion. – Include citations and a Source sheet in MLA or APA format. – Page count should be 10 – 15 pages for . No more than 20 pages. Double spaced. Include page numbers. Try to relate everything to United Nations human rights conventions or laws. Like the Geneva conventions and others.
