Dissenting Opinions
Dissenting opinions present a different view of the state of the law than the majority, but both the majority and dissent are based upon essentially the same law. This tension can be a valuable indicator of the progressive change in the law. Review the dissents in Roe v. Wade. Justice Rehnquist both joined in the dissent of Justice White, and wrote a separate dissent.
In your Discussion Board post, respond to the following:
- Discuss your theory as to why Justices Rehnquist and White dissented, as well as why Justice Rehnquist also wrote a separate dissent. Think about why they felt it necessary to dissent. What reasons did Justices White and Rehnquist state for disagreeing with the majority?
- Discuss your thoughts about whether Justices White and Rehnquist successfully supported their dissenting views.

I believe Justices Rehnquist and white dissented because they disagreed with the overall majority vote decision and thus they wrote a dissent to make it know their points about this case. I also feel that Justice Rehnquist decided to write a separate dissent because his reasons for needing a dissent and Justice Whites reasons for dissenting did not exactly meet eye to eye. Justice Rehnquist dissented for the reasons that he felt that the founders of the 14th Amendment did not intend for it to withdraw from the states the power to legislate in this matter. As well as he did not want for Abortion to be allowed no matter what the circumstances………………………………………..
