The parties that involved in negotiation in the movie are the following:

  • Harald Ott (Attorney General)

At the beginning of the movie, the FBI has arrested Rudolf Abel because he was a Soviet Union spy.  Even thought that the US government knows that Abel is a spy, They want him to get a fair trial to ensure that the Russian government won’t uses it against them. James Donovan, who is working for an insurance company, was asked by his boss at work to represent Abel in the court. Donovan accepted to be the lawyer of Abel even though that he knew that people would hate him for doing that. He believes that everyone deserves another chance. His family was the first people who tried to convince him to refuse the offer of being the Spy’s representative, but he insisted on taking the offer.

Later on at the court, the Jury has decided that Abel is guilty. Donovan tried to reject their decision, but Judge Byers refused his rejection. Judge Byers sat another court date to announce the sentence. Donovan knew that he has to do something otherwise his client would get the death penalty. So, he went the judge house trying to negotiate and convince him to keep Abel alive rather than give him the death penalty. Donovan told the judge that it was better for America to keep the Spy alive. The judge replied that he would reduce his sentence and keep him alive only if Abel would cooperate with the US government, but it doesn’t seem the Abel will do so. Donovan felt that he was losing the negotiation at this point. So, he told the judge that we could use him later on to trade if one of the US spies gets caught in Russia. The judge seemed that he accepted the idea, but he excused himself and ended the conversation without saying his thought of what the lawyer had said. When the time came to announce the sentence, the judge reduced the sentence from the death penalty to 30 years in prison. In this negotiation, Donovan had got what he wanted by reducing the sentence and leave Abel alive.

Another good negotiation happened in the movie took place in Berlin. Donovan had traveled to Berlin to make a deal with the Russian embassy to exchange prisoner. One of the US spies called Francis Powers was caught by the Soviet Union when he was spying on Russia. The lawyer has also heard that there is American student called Frederic Pryor has been arrested as a spy in East Berlin. The main interest for the CIA is to get Powers back and exchange him with Abel. On the other hand, the main interest for Donovan is the exchange both Powers and Pryors with Abel. In the beginning, the lawyer had a negotiation with the second secretary of the Russian embassy Ivan Schischkin and tried with him to include Pryor in the deal but Schischkin told him that he doesn’t have Pryor in his control. Schischkin had offered that if the US government released Abel, the Russian would release Powers after taking the needed information from him. Donovan refused the offer and asked for the same time exchange. Then Donovan started to threaten the secretary by saying that if Abel dies in the prison then the next Russian spy the American caught will rather share information about Russia than to go to the prison. The Secretary ended the conversation by saying that he has to call Moscow to discuss this matter.

Later on, Donovan went to the Security State of Germany to meet Wolfgang Vogel to discuss with him the possibility to release Pryors. After a short negotiation, Vogel accepted to exchange Pryors with Abel. A day later, Vogel has changed his mind after knowing that the lawyer has already negotiated with Russia. Vogel didn’t know that Russia is also involved in the deal. Donovan has threatened Vogel by saying that he will not accept any exchange unless both of his prisoners are back. Which means if the East Germany didn’t agree to release Pryors, Donovan would not make a deal with Russian to exchange Abel with Powers. If that happened then, East Germany is in trouble with Russia because they ruin the exchange agreement. In the end, East Germany agreed to make the deal. So, Donovan Has won the negotiation and exchanged Abel with Powers and Pryors.
